According to reports, the police eventually apprehended Oluwafemi and charged him with two fraud-related charges.

According to police prosecutor Akano Moremi, the defendant committed the crime in the state's Sabo district in October 2022.

The charge read:

That you, Oluwafemi Damilola, on the same date, time and place in the aforementioned magisterial district, did indecently assault the female victims by fraudulently and unlawfully having carnal knowledge of them with the pretence of sending them the sum of N45,000 which you failed to do so but willingly send them a fake alert with the aim of defrauding them sexually and thereby committed an offence contrary to and punishable under Sections 249 and 360 of the Criminal Code Cap 37 Volume 1 Law of Ondo State of Nigeria, 2006.”

However, the defendant's attorney, S. A. Iluyemi, stated that settlement negotiations were already underway.

He promised that the defendant would repay the complainants before the next adjournment date and requested the defendant's release from custody.

The request was approved by Chief Magistrate Charity Adeyanju, who stipulated that the money be paid to the complainants before the next adjournment date.
